View Full Version : Stopped by OHP tonight.....

Heading home to Claremore, came to the speed limit drop from 60 to 50 in Verdigris. I dropped to 50 and shortly after the hwy 266 overpass I see an OHP in my rear view mirror turn on his lights. I'm in the right lane and he is in the left lane. I don't think much of it since the Jeep in front of him was passing me and *I* was going 50. I thought the Jeep would get stopped for speeding.

Then the OHP pulls in behind me. [censored] I thought......why am *I* getting stopped. So I turn on my blinker and pull over. Turn on my interior light, roll down my window, take the keys out and put them on the instrument cluster.

Officer comes to my window asks for my information and says he stopped me for having my fog lights on! He says that I need to treat them the same as high beams.

I tell him that I need to reach into my glove box to get my insurance just to let him know of my actions. You know, don't want to make him think I might try something.....you can't be too careful. I get my insurance card out. DOUBLE [censored]! It expired February 28th! I KNEW I was going to get a ticket for that one!

I give him my license and insurance card. He asks if I still live at the Broken Arrow address. I said no I haven't lived there for about 3 years. He acts surprised. "You are supposed to correct your license within 10 days of moving". I told him I wasn't aware of that but that I figured that wasn't much of an excuse........

He takes my information and asks me to follow him to his car. In the car he runs my info, and everything comes back clear. He mentions something about it being good that my license isn't suspended because a notice would have been sent to my old address and I would have never received it since the address wasn't correct.

I'm guessing the officer pulled me over because he saw a fancy sport compact with a fog light violation and thought he would find some teenage punk driving it and there would be other violations with the car. But then he comes to the car and sees a guy that is almost 30 (holy $&@#!). The officer was really a nice guy and I treated him with respect. I even thanked him and shook his hand when he was finished! I think that's why he just gave me a warning for the fog lights and out of date address on the license. I did get a ticket for the insurance card, but I can go in Monday morning with my up to date insurance card and get it dismissed.

The sad thing is......my wife is my insurance agent and last night she asked if I had up to date cards in my car.......and I told her I did! Oh well....live and learn.

I knew a law had passed recently about the fog lights stating something along the lines that it had to be foggy for them to be used. I guess I ignored it since I like that little bit of extra light even though it is only up close to the car. But the officer told me that I have to follow similar rules as high beams. Must not be within 300 feet of another vehicle even with a median, unless the median is more than 300 feet wide. Conflicting information causes confusion.......

I guess the safest thing now is to NEVER use the damn fog lights. Why the hell are manufacturers putting them on just about EVERY car out there when you can't use them legally except when it is foggy......maybe 3 or 4 times a YEAR? Crazy I tell you....

That was the first time that I have been stopped in almost 8 years! And only the second time EVER! I'm going to pull the fuse on those fog lights so this doesn't happen again.

Since I am not going to use the fog lights, do you think it would be worth it to run some ducting from the driver's side fog light hole up to the air box to act kind of like a CAI? I don't want to buy a CAI where the filter is down low in the car. Don't want to run the risk of ingesting water as there are some MAJOR water puddles on the street leading to my house whenever it rains. Would piping the air from down there to the stock filter have a similar effect?

I figure that if I can't use them, I might as well take them out, right?

Getting pulled over sucks, especially for a BS reason. My old license had the wrong address on it for 2 months less than its 4 year life. On the back it says you must notify the state in writing within 10 days, it says nothing about getting the license changed. I don't know what the new one I just got says.

Not to stir up anything but I thought yellow beams were considered "fog lamps" and clear lamps are considered "driving lamps". (Hmmmm..... Loophole maybe?)

OHP must have been bored but it sounds like you handled the situation properly.

I got stopped in 92 while driving my 91 GT with driving lights on. They can be used, but only in cases such as fog, just like fog lamps.

I only got a warning, but I know that they stop people to check other things.

If you got a ticket for the insurance card, if you have the correct one they will remove the ticket.

The insurance card is real easy to forget to put in your car, until you get pulled over once without it.

"Front fog lamp" means a lamp mounted to provide illumination to the front of a motor vehicle during conditions of rain, snow, fog, dust, or other atmospheric disturbances;

A motor vehicle may be equipped with not to exceed two front fog lamps or two rear fog lamps which shall only be used when visibility, as described in paragraphs 3 and 4 of subsection A of this section, is limited to one-half (1/2) mile or less.

Front fog lamps shall be mounted on the same level on opposite sides of the front of the vehicle at or below the level of the headlamps. Front fog lamps may be used with lower beam headlamps or switch controlled in conjunction with the headlamps and may be used, at the discretion of the driver, with either low or high beam headlamps. Front fog lamps shall not be used in substitution of headlamps, when headlamps are required.

Every fog lamp or auxiliary driving lamp used upon a motor vehicle shall be so adjusted and aimed that no part of the high intensity portion of the beam shall, at a distance of twenty-five (25) feet, rise above the horizontal plane passing through the center of the lamp.

There's a copy of the law pertaining to fog lights. No mention of color.

I had my insurance card in my car....it was just expired by about a month. :o

I'm headed down to the court house in about an hour to get it taken care of.

hey Bill, I got my flash today. it is great. Talk to Sam Griffith at Ford of Tulsa South 280-6768. Tell him Joseph Wallis sent you and that you are having the same problems I was. He'll get you fixed up in a flash!....er with a flash.

EDIT: also, I need to get you the card of a guy here in town that can put on 3M Clearfilm to protect your fogs.

You have got to be kidding me. I always turn on my fog lights right after I turn the traction control off.

Sounds like BS on this end...up North here EH?

They may be able to get you on this part:

A motor vehicle may be equipped with not to exceed two front fog lamps or two rear fog lamps which shall only be used when visibility, as described in paragraphs 3 and 4 of subsection A of this section, is limited to one-half (1/2) mile or less.

Chances are, they thought they had a "boy racer" and thus a cash cow for a ticket. We have seen it up here for various items such as the windshield washer nozzle lights to having blue indicators and neon tubes that are on when the car is not on the road

That sounds suspiciously like a headlight to me. I also noticed that this is the definition of visibility given in paragraphs 3 and 4 of subsection A.

A motor vehicle may be equipped with not to exceed two front fog lamps or two rear fog lamps which shall only be used when visibility, as described in paragraphs 3 and 4 of subsection A of this section, is limited to one-half (1/2) mile or less.

I don't know about you guys, but I can't see anything 1/2 mile away in the dark.

.....Front fog lamps may be used with lower beam headlamps or switch controlled in conjunction with the headlamps and may be used, at the discretion of the driver, with either low or high beam headlamps.

....may be used at the discretion of the driver.... So are they illegal or not?

Every fog lamp or auxiliary driving lamp used upon a motor vehicle shall be so adjusted and aimed that no part of the high intensity portion of the beam shall, at a distance of twenty-five (25) feet, rise above the horizontal plane passing through the center of the lamp.

Unless there has recently been a monumental discovery in the field of physics, light doesn't bend. If the beam is focused below the horizontal center line of the lamp, it will be below the center of the lamp no matter how far away you are from the lamp. This is the stupidest thing I've ever heard. Using this logic, they could cite you for using your lights while going up hill. If your lights are aimed 5 degrees down, but you are travelling up a 10 degree hill, the beam will be focused 5 degrees above the horizontal center of the bulb while travelling up the hill. This portion of the law (the whole law actually) is almost as useful as the law that bans taking your pet elephant for a walk in downtown Tulsa.
